Woman killed peacock, asks for case dismissal

In breaking news today, Sandra Maloney, who killed a peacock last year with a bat is asking for her case to be dismissed, reports Advertiser reporter Jim Dooley.

From the story:

"Sandra Maloney's attorney argued that the statute used to charge her is vague and does not apply to peacocks.

The lawyer, Randall Oyama, also cited testimony from a zoo expert who said that the method used by Maloney to kill the bird was 'humane.'"

I'm bothered by this.  How can killing a living thing with a baseball bat be considered "humane?"

    i don't care how upset an animal makes me. i would never bludgeon it to death.

    how can her attorney think this is humane? and convince others to accept this excuse?

    This is just their defense to try and get them off the hook. They know it was wrong. I'm surprised they didn't claim self defense.

    hi nkhea.. yes. extremely sad..

    i hope she doesnt' get away with it.. then everyone can say they clubbed something with a bat to be "humane."

    they'll probably try that later if "humane killing" doesn't work.

    she was lacking sleep the bird was taunting her...if she run the bird over what would her sentence be...she can volunteer in the bird rescue places.

    I think her sentence is to be place in the zoo with peacocks and try her best not to chocke them..

    the bird so noisy ..but how come the owner of the condo didn't hire a bird person to keep the birds away ....

    my favorite quote is, "they are detrimental to human life." ha! people are more dangerous to one another... i'd also like to ask that zoo expert if he or she is in the right working field...

    Yah, I don't get how using a bat would be considered humane? I really hope she doesn't get away with it. I'm sure it was driving her crazy, but there must have been other things she could have done?

    I've read articles where people are upset at the street cleaners, for being loud and they can't sleep, but you see them getting humanely killed with a baseball bat? I don't think so.
